What Every Practitioner Needs to Know About e-Discovery

Anticipated CLE credits: 3 General Credits, of which 1 may be allocated to Ethics

Designed to provide an overview of the basics of e-discovery, this program will explain what e-discovery is, why attorneys must be concerned about it and how it impacts daily practice, including attorney-client privilege. Federal and state e-discovery rules, caselaw and a focus on current concerns in Washington state will also be discussed. A third session will explore ethical issues arising from metadata and the Qualcomm decision, and a final session will focus on concerns of in-house counsel.

Discussion of the Federal Rules, case law interpreting those rules, ER 502, State e-discovery rules, those that have adopted changes and those that are considering them, including an update on the state of Washington's efforts
10:40 - 10:50 a.m. Refreshment Break
10:50 a.m. - noon Session 3: Ethical Concerns: Metadata and Qualcomm

This session will explore ethical issues related to metadata and the Qualcomm decision.
