Biography

Todd Nunn is a litigation partner in K&L Gates' Seattle office. His current practice emphasizes complex litigation, class action defense and electronic discovery.

Todd defends class actions on behalf of corporate and governmental clients. His class action defense experience includes defense of numerous nationwide and statewide breach of contract and consumer protection class actions. He has also defended government regulation, breach of warranty, products liability, environmental, employment and securities class actions. Todd is the Co-Editor and Author of "State Class Actions: Practice and Procedure," a 51 chapter loose leaf treatise that provides a comprehensive treatment of state class action laws for all 50 states and the District of Columbia. Todd was also the Co-Editor of the 2007 updates for Linda S. Mullenix, State Class Actions Practice and Procedure (2006). He is currently co-editing and authoring a treatise on defense of class actions in federal court, to be published in 2012.

Todd also practices in e-Discovery and is a member of the K&L Gates e-Discovery Analysis and Technology Group. Todd represents clients in complex document production projects, including nationwide class actions. He was the author of a chapter of the 2006 DRI Treatise, "Understanding the New E-Discovery Rules." Todd has been a court appointed arbitrator and has been appointed as a special master for e-discovery disputes. He is a member of the Washington Bar Association Escalating Cost of Civil Litigation Task Force, which will look at the causes of escalating litigation costs. Todd will chair the subcommittee on discovery costs. Todd was a member of the Washington State Bar Association Court Rules and Procedures Committee for five years, and was the Chair of the ESI Discovery Subcommittee, which was assigned the task of evaluating and recommending any needed e-discovery specific amendments to the Washington State Rules of Civil Procedure.

Todd is a graduate of the University of Washington School of Law. He was an articles editor on the Pacific Rim Law and Policy Journal. He was also a member of the Moot Court Honor Board and was awarded membership in the National Order of Barristers.
