Mission

The mission of the Institute for Indian Estate Planning and Probate is to assist Indian people in making informed decisions about their property by:

  1. Establishing regional projects which provide free and reduced cost estate planning services to tribal members;
  2. Providing estate planning information and training to tribal governments, officials and the legal community; and
  3. Serving as a clearinghouse for current information on Indian estate planning, tribal probate codes, and the American Indian Probate Reform Act.

Who We Are

The Indian Land Tenure Foundation recognized the need for a unified, comprehensive, and efficient approach to estate planning in Indian Country, particularly following the passage of the American Indian Probate Reform Act and the announcement in April 2005 that the Bureau of Indian Affairs would no longer be drafting or storing wills for tribal members.

Believing a national program was essential, the ILTF created the Institute for Indian Estate Planning and Probate which began operations August 1, 2005.

The Institute oversees existing ILTF projects that provide free or reduced cost Indian estate planning services to Tribes in the States of Washington, Oregon, Idaho, North Dakota, South Dakota and Wisconsin. These include Indian estate planning projects at the University of Idaho, the University of Wisconsin and Dakota Plains Legal Services.

The primary objective of the Institute is to grow into a national program that directly impacts and reduces the fractionation of Indian lands through education and the provision of estate planning services to tribal members and communities.
